Definitions
This document outlines the Terms and Conditions between FmSoft Private Limited (“FmSoft”) and “the Client” regarding website design, software development, and other services provided by FmSoft Private Limited. These terms govern how the Client may use the services supplied by FmSoft Private Limited.
Permission and Copyright
Copyright of designs, images, code, and source files created by FmSoft Private Limited transfers to the Client only upon final payment unless otherwise agreed in writing. Without such agreement, ownership remains with FmSoft Private Limited. Clients may use the design on one website only, and resale or distribution of the files is prohibited unless explicitly permitted by FmSoft Private Limited. The Client must ensure that all media provided to FmSoft Private Limited is owned by the Client or used with proper permissions.
Initial Work and Content
FmSoft Private Limited will commence projects upon receipt of necessary materials from the Client. Project timelines will vary based on Client requirements. Clients are expected to provide content within 7 days of project start. Delays in content submission may incur additional charges and can lead to project cancellation if not addressed within the extended timeframe.
Alterations and Redesigns
Clients must request alterations within three days after the initial submission of work. Any changes requested post-approval will be considered redesigns and may incur additional costs. Errors identified by the Client will be promptly rectified.
Free Maintenance
FmSoft Private Limited offers one year of free maintenance for runtime errors, excluding content updates.
Quotation Validity
Quotations are valid for 7 days. Prices may change without notice after this period.
Material Rights
FmSoft Private Limited reserves the right to refuse to handle media that is unlawful, inappropriate, or contains harmful programs.
Refund Policy
Refunds are considered under specific circumstances:
- Full Refund: If the project has not started or the initial design is not approved.
- Partial Refund: If there is a failure to deliver as per the delivery policy after initial design approval.
- No Refund: If the project is completed and uploaded.
For any dissatisfaction, efforts will be made to reach a mutually acceptable solution before considering refunds.
